Ofek is a pre-launch personal health record service operated by Ofek Health, Inc., a Delaware corporation incorporated through Stripe Atlas.
Acceptance
By creating an account, connecting a data source, uploading records, or using Ofek, the user agrees to these terms and the Privacy and Security Notice. If the user is acting for another person, the user represents that they have legal authority to act for that person.
Service
Ofek helps users request, store, organize, cite, export, and share their own health information. Ofek may use software and AI-assisted workflows to parse source records and draft summaries, timelines, insights, and visit prep materials.
Ofek is not a medical provider, hospital, health plan, or emergency service. Ofek does not provide medical advice, diagnosis, or treatment. Users should contact a licensed clinician for medical questions and call emergency services for urgent medical needs.
Health Records and Consent
The user controls which records they request, upload, export, print, or share. Before Ofek requests records through an exchange pathway or third-party service, the user must provide express consent. The user can revoke consent for future requests.
Ofek may not be able to retrieve every record, match every source, parse every document, or detect every error. Users should review source records and share corrections or wrong-patient concerns with Ofek.
AI Drafts and Clinician Review
AI-assisted outputs are drafts unless clearly marked as reviewed by a credentialed clinician. AI drafts may be incomplete, out of date, or wrong. Users should not treat AI drafts as medical advice.
User Responsibilities
- Provide accurate account, demographic, and authorization information.
- Use Ofek only for the user or another person the user is legally authorized to represent.
- Keep account credentials secure.
- Do not upload unlawful, malicious, or irrelevant content.
- Do not attempt to access another user's account or records.
- Do not interfere with the security or operation of Ofek.
Data Use
Ofek uses user information as described in the Privacy and Security Notice. Ofek does not sell individually identifiable information and does not use health information for targeted advertising.
Third-Party Services
Ofek may rely on third-party services for authentication, identity proofing, record retrieval, hosting, storage, communications, and AI-assisted processing. These services may have their own terms and privacy notices. Ofek uses service providers to operate the service under privacy and security obligations.
Fees
Ofek does not currently charge a separate fee for Individual Access Services. If Ofek introduces paid services, it will disclose pricing before charging.
Account Suspension or Termination
Ofek may suspend or terminate access if a user violates these terms, creates security risk, misuses the service, or uses the service in a way that could harm another person or the integrity of health-information exchange.
No Warranty
Ofek is provided during a pre-launch period and may change, break, or be unavailable. To the maximum extent permitted by law, Ofek is provided without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, Ofek will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity. Nothing in these terms limits liability where the law does not allow that limitation.
Changes
Ofek may update these terms or the Privacy and Security Notice. Material changes will be disclosed through the service or by email when appropriate. Continued use after an update means the user accepts the updated terms.
